The Demise of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis sparked by the introduction of a new 28-article proposal for ending the war appeared – briefly – to have been contained. A Washington representative spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its countermove: an extensive attack of rocket attacks on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of contrasting events captured the grim essence of the outgoing year. By day, negotiation efforts are conducted: optimistic declarations are issued from multiple capitals. Considerable effort is allocated on containing specific proposals. By night, the Kremlin clearly shows the world that, for them, military action persists as the main instrument for achieving "peace".

Nocturnal Warfare

As the offensive progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is capable of detecting projectile deployments from Russian territory, a capacity enabled by current data. From witness perspectives, Ukrainian air force fighter jets that had been deployed to engage hostile aerial threats roared overhead – sophisticated military planes delivered to Ukraine by NATO members.

Shortly after, Kyiv's anti-aircraft weapons activated: several firings targeted at a hostile projectile. This was a sophisticated defense system at work, presumably delivered by partner states. Every launch creates sudden vibrations, causing tremors. The brief panic quickly gives way to sober acceptance: possibly the incoming missile won't hit its mark this time, sparing the city from catastrophe and additional electricity failures.

Persistent Threats

Not long after, a heavy machine gun fired at a aerial vehicle close by, part of a rapid response unit – probably allied-provided weaponry. Regrettably, the bullets missed the enemy aircraft – it continued its flight toward its target.

With pauses, this carried on until dawn. Kyiv awoke to the daybreak reports: seven people killed, devastation and infrastructure problems in many homes as a result of the evening attack. As customarily, everyone still continued their routines – living the war. But those full day encapsulated Ukraine's critical military reliance on international aid – a reliance that neighboring countries are clearly incapable to replace in the immediate future.

Unsuccessful Negotiations

The detailed framework from American leadership sparked intense emotion, discussion and serious worry – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and bilateral conferences.

Every new approach from American administration unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They contain the crisis but never actually secure success. This cycle will, no doubt, continue.

Tactical Assessments

It is tempting to accuse particular leaders of consistently pushing Kremlin's demands. But that does not seem to be the whole story. Washington functions according to a assumption well known to experienced diplomats: you cannot win at the negotiating table what you have failed to defend militarily. The White House assumes that it is unrealistic to pressure the Kremlin to relinquish the areas that it presently holds in Ukraine's occupied territories.

The problem is that while acknowledging this situation, US leadership does little to discourage Russia, through words or deeds, from thinking that the status quo will not change more in its favour in the months ahead.

Opposing Positions

Therefore, Moscow is convinced that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their incentive to agree to terms that does not give them the maximum possible gain is virtually nonexistent. There may be numerous efforts to stop fighting, but they will persist as long as Russia's leader remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, gradually sacrificing lives and land but averting a entire defensive failure until conditions improve in its favour.

Existing Situation

Objectively, there are no actual prerequisites for a truce. Now, subjective factors are entering the equation: political desires to mediate resolution and achieve global acclaim, and Kyiv's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the national cause against any plan Kyiv finds unacceptable, so that their focus does not switch to internal issues. And although their task will now be much harder after recent developments, it remains quite doubtful that this will modify their basic position.

These opposing factors are driving the talks.

Assessment and Future

It took a mere seven days to eliminate the 28 points of the latest plan. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, recent disclosures, all achieved their purpose.

While new proposals based on established approaches are forthcoming, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are founded on Moscow's terms and show particular unwillingness to change the course of events, if they stand together and improve their protective measures at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the coming months, primarily depend on sustained allied backing.
